Joszek Brody’s creative educational platform “School from the forest”
version in force as of 01 September 2023.
These Terms and Conditions (hereinafter also: “Terms and Conditions“) have been drawn up by Jozef Broda conducting business under the name “Firma z lasu Jozef Broda” (hereinafter also: “Forest Company“) in accordance with Art. 8 para. 1, 3 and 4 of the Act of 18 July 2002. on the provision of services by electronic means (i.e. Journal of Laws 2020, item 344, as amended).
The Forest Company publishes these Terms and Conditions in order to set out the rules for the use by Users of Joszek Brody’s Creative Educational Platform “School from the Forest”, hosted at: www.szkolazlasu.pl (hereinafter also: “Platform” or “Educational Platform“) enabling Users to make use of the Educational Services provided by the Forest Company via the Platform.
By using the Platform, the User confirms that he/she has read these Terms and Conditions and undertakes to comply with them.

§1. PRELIMINARY PROVISIONS
- Joszek Brody’s creative educational platform “School from the Forest”, run at: www.szkolazlasu.pl (hereinafter also: “Platform” or “Educational Platform”), aims to support children, pupils, parents, teachers, schools, institutions and any other persons or entities in their educational and cultural development in selected fields of science, culture and art against payment.
- The entity operating the Platform is Józef Broda conducting business activity under the name “Firma z lasu Józef Broda”, Koniaków 701, 43-474 Koniaków, NIP: 5481753246, REGON: 060284143, tel. +48 600 248 131, e-mail address: kontakt@szykolazlasu.pl (hereinafter also: “Firma z lasu” or “Service Provider”).
- The Platform operates in accordance with these Terms and Conditions, which in particular set out the rights and obligations of Platform users in relation to their use of the Platform and the Educational Services.
- Before using the Platform, the User must carefully read and comply with the provisions of these Terms and Conditions and the other documents provided by the Forest Company via the website.
- Users are entitled to use the Educational Services exclusively for their own private purposes (personal use) in places that are inaccessible to an unspecified number of people, such as, in particular, restaurants, bars, shops, waiting rooms, outdoor spaces, in accordance with §6. paragraph 1 of these Regulations.
- The creation of an account on the Platform and the purchase of a Subscription or participation in an Event may only be carried out by a person with full legal capacity.
§2. DEFINITIONS
Whenever the following terms are used in the Rules, they shall be understood as follows:
- Firma z lasu, Service Provider – Józef Broda conducting business under the name “Firma z lasu Józef Broda“, Koniaków 701, 43-474 Koniaków, NIP: 5481753246, REGON: 060284143, tel. +48 600 248 131, e-mail address: kontakt@szykolazlasu.pl;
- Consumer – a natural person making a legal transaction with a trader which is not directly related to his/her commercial or professional activity;
- Education course – a series of paid educational Lessons in selected fields of science, culture and art, organised by the “forest company” by means of distance communication; the conditions of participation in the Educational Course, the nature of the Educational Course, the Teacher designated by the “forest company” to conduct the course, the duration of the Lesson, the dates and the subject matter of each Lesson will be specified in the description of the Educational Course on the Platform;
- Trainee – a user who has purchased participation in an Educational Course;
- Lesson – a meeting with a Teacher within an Educational Course, during which the Teacher imparts knowledge to the Students from selected fields of science, culture and art, according to the topic of the Educational Course according to the rules and in accordance with the description of the Educational Course on the Platform;
- Educational material – materials improving the process of teaching, learning and development in the form of video materials (courses) in selected fields of science, culture and art developed by the Forest Company, which are available to the Students of the “Forest School”;
- Teacher – a natural person imparting knowledge to the Participants of an Educational Course within the framework of the Lesson in selected fields of science, culture and art, according to the subject matter of the Educational Course according to the rules and in accordance with the description of the Educational Course on the Platform and having the relevant qualifications;
- Platform, Educational Platform – the Internet platform at the address: www.szkolazlasu.pl, operated by the Forest Company under the name: Joszek Brody’s Creative Educational Platform “School from the Forest”, enabling Users in particular to use Educational Services against payment;
- Entrepreneur with Consumer Rights – a natural person concluding a contract directly related to his/her business activity, where it follows from the content of the contract that it is not of a professional nature for that entrepreneur, arising in particular from the subject of his/her business activity made available on the basis of the provisions on the Central Register and Information on Business Activity;
- Listener, Listener of the “School from the Forest”, Listener of the Platform – a User who has purchased a Subscription;
- Subscription – paid access to the Educational Platform purchased by the User, thanks to which educational materials are unlocked on the account of the “School from the Forest” Listener;
- Auto-renewable Subscription – Subscription for which cyclic payment is charged automatically by the Service Provider using the same payment method used by the User to order the Subscription; cyclic payment in monthly cycles, in the amount of the monthly price for a given Subscription package in force at the time of ordering, in date of expiry of the User’s previous billing period; (If payment cannot be collected, the subscription will lapse);
- Subscription for schools – paid access to the Platform for various types of educational institutions such as, in particular, schools and establishments within the meaning of the Act of 14 December 2016. Education Law, the terms and conditions of which, as well as the fees, are agreed individually with the Service Provider; the initiation of contact by a school or institution with the Forest Company can take place in particular via the registration form for schools – “Place an order”;
- Non-recurring subscription – Subscription for a period of time selected by the User and paid for in a single payment; only natural persons may take out a nonrecurring subscription;
- School – various types of educational institutions such as, in particular, schools and establishments within the meaning of the Act of 14 December 2016. Education Law;
- Event Participant – A User who has purchased participation in an Event;
- Educational Service – a paid electronic service provided via the Platform by the Forest Company for the benefit of Students of the “School of the Forest”, Event Participants and Learners, aimed at educational and cultural support in selected fields of science, culture and art through, in particular:
- making Educational Material such as courses available to Listeners for their own use (payment is made by taking out a Subscription),
- the organisation of Educational Events and the participation of Event Participants (payment is made by purchasing participation in a specific event),
- the organisation of Educational Courses and the participation of Trainees in them (payment is made by purchasing participation in a specific Educational Course).
whereby the detailed scope of the offered Educational Services is presented to the User via the Platform;
- User – any person or entity that uses the Learning Platform;
- Event – a paid event of an educational nature in selected fields of science, culture and art, organised by the Forest Company by means of distance communication, at a date and under conditions specified each time in the description of the event on the Platfo
- Registered User – A User who has created an account on the Learning Platform website.
§3. SERVICES PROVIDED BY THE PLATFORM
The Service Provider, through the Learning Platform, enables Users to make use of:
- free services and functionalities,
- Paid Educational Services.
§4. CONDITIONS OF USE OF THE PLATFORM
- Use of the Platform is voluntary and available to all Internet users residing in the Republic of Poland.
- Educational materials, Educational events and Educational courses are dedicated to children, pupils, parents, teachers, schools, institutions and any other person or entity supporting educational and cultural development. However, registration on the Platform, purchase of Subscription to Educational Material, participation in Educational Events and participation in Educational Courses may only be made by persons who have full legal capacity. The User who has registered or purchased independently decides whether to grant access to their account on the Platform and purchased Subscriptions or participation in the Event to other persons (according to the number of accesses purchased).
- The use of Educational Material, Events and Educational Courses is generally allowed for users of all ages, although the Educational Material, Events or Educational Courses may specify a minimum age for persons to whom the Material, Event or Educational Course is dedicated.
- Use of the Platform requires the existence of an active connection between the user’s tool and the Internet. The requirements for network connection for each tool vary, however, in all cases it is essential to use a correctly installed web browser. At the same time, it is advisable to use the latest version of the web browser operating system.
- The forest company is not responsible for technical problems related to the hardware or software used by the User, nor for problems with the Internet network used by the User.
- The User is obliged to use the Platform in accordance with its purpose, in a manner consistent with the content of these Terms and Conditions, the provisions of generally applicable law and the principles of social co-existence.
- As part of the use of the Platform, it is specifically prohibited to:
- provision by the User of unlawful content,
- infringement by the User in any way whatsoever of the personal rights of other Users, the Forest Company and its employees and affiliated persons,
- In the areas intended for the insertion of personal data, it is prohibited for the User to provide false personal data, including, in particular, the insertion of other people’s personal data,
- undertaking any action by the User aimed at interfering in any way with the functioning and the software of the Platform or the Educational Services, including in in particular, undertaking hacking activities aimed at breaking the security of the website, placing any files, applications or programs that have a negative impact on other users, the Forest Company, the Platform or the Educational Service (so-called viruses, Trojans, worms, backdoors, malware),
- the User taking actions that cause disruptions or overload of the IT systems of the Platform or other entities participating directly or indirectly in the provision of electronic services by the Forest Company,
- the User uses the materials made available via the Platform in a way other than for personal use,
- the User’s use of transmission streams beyond the scope of providing the Educational Service, i.e. in particular, transferring the source of streams to third parties/entities.
8. The use of the Platform may be temporarily hindered or prevented in the event of technical problems or temporary disabling of access to the Platform due to its modernization or increased functionality, of which Users will be informed in advance.
§5. FREE OF CHARGE PLATFORM SERVICES AND FUNCTIONALITIES
- Through the Platform, the forest company enables its Users to:
a. browsing free content posted on the Platform, i.e. in particular a blog, course presentations in the form of trailers, etc.,
b. using the contact form,
c. create an account;
d. newsletter subscription. - Browsing free content posted on the Platform is a functionality that does not require the User to take any actions other than basic operation of the Platform’s interface.
- The contact form is a functionality of the Platform that allows you to send a message to the Company from the forest using the form located on the Platform’s website. At any time, the User may resign from using the Contact Form by ceasing to send messages to the Company from the forest.
- Creating an account on the Platform takes place in accordance with the provisions of §7 of these Regulations.
- The newsletter subscription takes place in accordance with the provisions of §12 of these Regulations.
§6. EDUCATIONAL SERVICE
- The User has the right to use Educational Services only for his or her own private use, not directly related to the business or professional activity conducted, in accordance with §1 point 5 of these Regulations, with the proviso that their own, private use of educational institutions is deemed to be non-profit. educational activity consistent with the paid Subscription or participation in the Event. Any use by the User for purposes other than private purposes of any of the elements constituting the content of the Educational Services may result in the User’s legal liability, which will be pursued by the Forest Company or other authorized entities under generally applicable regulations.
- The provision of the Educational Service is intended to provide educational and cultural support to Listeners and Event Participants in selected fields of science, culture and art and is paid.
- The educational service offered by the Forest Company via the Platform is provided through:
a. making Educational Material such as courses available to Listeners for their own use (payment is made by taking out a Subscription),
b. the organisation of Educational Events and the participation of Event Participants (payment is made by purchasing participation in a specific event),
c. the organisation of Educational Courses and the participation of Trainees in them (payment is made by purchasing participation in a specific Educational Course). - In each case, the detailed scope of the offered Educational Services is presented to the User via the Platform, i.e. in particular, the price, settlement terms and possible number of accesses are indicated. The Subscription Terms and Conditions of Participation in Educational Courses for schools and institutions are presented in the form of individual offers. Purchasing a subscription allows the School to participate in the Events.
- Users can use the Educational Services by using a web browser correctly installed on the end device.
- The purchase of a Subscription/participation in an Event/participation in an Educational Course entitles the User to one access, i.e. only one User may use the Educational Service purchased by the User. The User may use the Educational Services on any number of end devices, however, using one end device prevents the use of another end device at the same time.
- In order to eliminate any doubts, it is pointed out that the Forest Company is in no way responsible for the User’s access to the Internet, the quality of this access or the fees paid for this access. The User provides access to the Internet, web browser and end devices on his own.
§7. ACCOUNT REGISTRATION ON THE PLATFORM
- In order to register the User on the Platform, the User uses the interactive registration form, which requires:
- provide the e-mail address necessary to register an account, which also becomes the User’s individual login to the Platform,
- provide personal data necessary to register an account on the Platform (in particular: name and surname, possibly company name, Tax Identification Number, address, contact details),
- create an individual password,
- truthfully – confirm that you have read these Regulations and the Privacy Policy and accept all their provisions,
- optionally, consent to receiving the newsletter.
- After completing the registration form, the address is verified by e-mail
User’s e-mail by sending an activation link to the indicated e-mail address. After activating the account, the User can log in to his or her account on the Platform and order the selected Educational Service. - The User is responsible for maintaining the confidentiality of access data to his/her account on the Platform, i.e. individual login and password.
- The User has the right to delete his/her account at any time by sending such an intention to the following address: kontakt@szykolazlasu.pl, provided, however, that the account cannot be deleted if an active, paid Subscription is assigned to it (until it expires).
- The forest company has the right to delete an inactive User account, i.e. such that the User has not logged in to the Platform for a period of at least 24 months, provided that he or she has not purchased a Subscription.
§8. SUBSCRIPTION TO EDUCATIONAL MATERIAL
- Subscription is paid access to the Educational Platform purchased by the User, thanks to which Educational Materials are unblocked on the “Szkoły z las” Listener’s account.
- In order to purchase a Subscription and start using it, it is necessary to register an account on the Platform.
- The following types of Subscriptions can be purchased via the Platform:
a. One-time subscription – Subscription for a period selected by the User, for which payment is made once; Only individuals can purchase a one-time subscription;
b. Auto-renewable subscription – Subscription for which the recurring payment is collected automatically by the Service Provider using the same payment method that the User used when ordering the Subscription; a recurring payment is charged monthly, in the amount of the monthly price for a given Subscription package applicable at the time of placing the order, on the day of the expiry of the User’s previous billing period (if it is not possible to collect the fee, the Subscription expires);
c. Subscription for schools – paid access to the Platform for various types of educational institutions, such as in particular schools and facilities within the meaning of the Act of December 14, 2016. Educational law, the terms and conditions of which are agreed individually with the Service Provider; contact between a school or an institution with the Forest Company may be initiated, in particular via the registration form for schools. - A registered and logged in Individual User places an order for a selected Subscription package from among the proposals presented by the Forest Company via the Platform. The subscription package agreed individually with the School will be allocated to the school’s account after paying the VAT invoice in accordance with the individually accepted offer. After assigning the Subscription package, the School will assign students to accounts on the Platform in the number resulting from the accepted offer.
- To place an order, please:
a. indicate the selected Subscription package,
b. truthfully – confirm that you have read these Regulations and the Privacy Policy and accept all their provisions,
c. consent to the provision of digital content not delivered on a durable medium (before the expiry of the 14-day period for withdrawal from a distance contract), which involves the loss of the User who is a Consumer or an Entrepreneur with consumer rights of the right to withdraw from the contract concluded with the Company from the forest ,
d. make a payment through an external entity handling the payment transaction,
e. optionally consent to receiving the newsletter, - When the User places an order and makes the payment, an agreement is concluded between the User and the Forest Company for the provision of educational materials for a specified period (in the case of a one-time Subscription) or for an indefinite period (in the case of an auto-renewable Subscription).
- The provision of the service begins immediately after the conclusion of the contract.
- Depending on the type of Subscription selected by the User, he is granted access to Educational Materials for a selected number of accesses:
a. for a selected fixed period (for a one-time subscription)
b. for an indefinite period (with auto-renewable Subscription). - Termination of a contract concluded for a fixed period takes place upon expiry of the paid period of access to Educational Materials. Termination of an agreement concluded for an indefinite period may occur at any time, subject to a one-month notice period, by sending the User a notice of termination to the Forest Company by e-mail to the following address: ______ or by the Company sending the User a notice of termination by e-mail to the address provided by the User when registering an account on the Platform.
- The forest company may change the fees for access to Educational Materials at any time, provided that Users will be informed by e-mail about the change in fees, and fees for Users already using the Auto-Renewable Subscription will change only when the next fee is charged. The User may then terminate the contract with effect at the end of the current billing period within 14 days from the date of receipt of notification of the change in fees.
- The forest company may terminate the User’s contract in the cases referred to in §14 of these Regulations.
- In order to eliminate any doubts, it is indicated that the fees paid are non-refundable, except in the situations provided for in generally applicable regulations.
§9. PARTICIPATION IN EDUCATIONAL EVENTS
- An event is a paid educational event in selected fields of science, culture and art, organized by the Forest Company via means of distance communication, on the date and under the conditions specified each time in the description of the event on the Platform.
- In order to purchase and participate in the Event, it is necessary to register an account on the Platform.
- Participation in the Event is purchased by the User making a one-time payment for participation in the Event.
- In order to purchase participation in the Event, you must:
a. add the selected participation in the Event to the cart via the online store,
b. complete a dedicated purchase form, i.e. in particular, provide the necessary personal data (in particular: name and surname, possibly company name, Tax Identification Number, address, contact details),
c. truthfully – confirm that you have read these Regulations and the Privacy Policy and accept all their provisions,
d. confirm that the performance of the service within the time of the planned Event may result in the User who is a Consumer or an Entrepreneur with consumer rights losing the right to withdraw from the contract concluded with the Company from the Forest if the Event takes place before the expiry of the 14-day deadline for the withdrawal in question,
e. make a payment through an external entity handling the payment transaction,
f. optionally consent to receiving the newsletter, - When the User places an order and makes the payment, an agreement for the provision of the service of participation in the selected Event is concluded between the User and the Forest Company.
- In order to eliminate any doubts, it is indicated that the fees paid are non-refundable, except in the situations provided for in generally applicable regulations.
§10 PARTICIPATION IN EDUCATIONAL COURSES
- An educational course is a series of paid educational lessons in selected fields of science, culture and art, organized by the Forest Company, via means of distance communication. The conditions of participation in the Educational Course, the nature of the Educational Course, the Teacher appointed by the Company from the forest to conduct the Educational Course, the duration of the Lessons, the dates and topics of individual Lessons will each time be provided in the description of the Educational Course on the Platform.
- The forest company reserves the right to cancel the Lesson for an important reason, about which the Students will be informed via the Platform no later than one day before the planned date of the Lesson, unless an important reason occurred later. The new Lesson date will be announced to Students via the Platform.
1.3. It is not possible for students to change the lesson date.
2.4. The forest company reserves the right to change the Teacher during the Educational Course for an important reason.
3.5. In order to purchase and participate in the Educational Course, it is necessary to register an account on the Platform.
4.6. The purchase of participation in the Educational Course is made by the User making a one-time payment for participation in the Educational Course.
5.7. In order to purchase participation in the Educational Course, you must:
a. add the selected participation in the educational course to the cart via the online store,
b. complete a dedicated purchase form, i.e. in particular, provide the necessary personal data (in particular: name and surname, possibly company name, Tax Identification Number, address, contact details),
c. truthfully – confirm that you have read these Regulations and the Privacy Policy and accept all their provisions,
d. confirm that you are aware that the provision of services within the time limit of the planned Educational Course may result in the User who is a Consumer or an Entrepreneur with consumer rights losing the right to withdraw from the contract concluded with the Company from the forest if the Educational Course takes place before the expiry of the 14-day period to make the said withdrawal,
e. consent to the processing of the child’s image in the form of sound and image transmission through a device on the Student’s computer that records sound and image (webcam) in order to effectively transfer knowledge in selected fields of science, culture and art in accordance with the subject of the educational course in connection with the contract concluded with the Company from the forest by agreement; in the case of a child under 13 years of age, consent is given by the child’s parent/legal guardian; in the case of a child over 13 years of age, consent is given by the child himself and the parent/legal guardian confirms the consent,
f. make a payment through an external entity handling the payment transaction,
g. optionally consent to receiving the newsletter,
3.8. When the User places an order and makes the payment, an agreement for the provision of services in the selected educational course is concluded between the User and the Forest Company. - In order to eliminate any doubts, it is indicated that the fees paid are non-refundable, except in the situations provided for in generally applicable regulations.
§11. HANDLING ONLINE PAYMENTS
- Payments for Subscriptions and participation in Events and Educational Courses are processed by an external entity handling payment transactions, and the company from the forest does not collect payment card details or any other bank details of the User – this information is transferred directly to the external entity processing the payment.
- The external entity handling payment transactions via the Platform is Przelewy24. Information about the processing of Platform Users’ data by this entity in connection with online payments can be found here: https://www.przelewy24.pl/obowiazek-informacyjny-rodo-platnicy
- When making a payment transaction, the User can choose from the following payment methods:
a. Online transfer supported by mBank, iPKO, Santander – Przelew24, Bank Peko S.A., Alior Bank, Konto Inteligo, Credit Agricole, Citi Handlowy – Pay with Citi Handlowy, VeloBank, BNP Paribas, Bank Ochrony Środowiska – Pay with BOŚ, Bank Pocztowy, Banki Spółdzielcze, Volkswagen Bank, Nest Bank, Plus Bank – I pay with Plus Bank, Bank Nowy S.A., Toyota Bank, Kasa Stefczyka, Millennium Bank;
b. Prepayment;
c. Traditional transfer;
d. BLIK code;
e. PayPo.
§12. WITHDRAWAL FROM THE CONTRACT BY THE CONSUMER
AND BY THE ENTREPRENEUR WITH CONSUMER RIGHTS
- In the event of concluding a Subscription contract, the User who is a Consumer or an Entrepreneur with consumer rights loses the right to withdraw from the distance contract within 14 days from the date of its conclusion due to the fact that the User, when placing the order, consents to immediate performance (before expiry of the 14-day period for withdrawing from a distance contract), being informed about the loss of the right to withdraw from the contract, and then receiving confirmation that the Company has received the consent to provide digital content from the forest in circumstances resulting in the loss of the right to withdraw from the contract.
- The above is justified by the content of Art. 38 section 1 point 13) of the Act of May 30, 2014 on consumer rights, according to which the right to withdraw from an off-premises or distance contract is not available to the Consumer in relation to contracts for the supply of digital content not delivered on a tangible medium for which the Consumer is obliged to pay the price if the entrepreneur has commenced the provision with express and express consent. the prior consent of the Consumer, who was informed before the commencement of the service that after the entrepreneur has provided the service, he will lose the right to withdraw from the contract, and has acknowledged this, and the entrepreneur has provided the Consumer with the confirmation referred to in Art. 15 section 1 and 2 or art. 21 section 1 of the above-mentioned Act. This exclusion also applies to the Entrepreneur with consumer rights.
- If a contract for participation in the Event is concluded before the expiry of the 14-day period for withdrawal by a User who is a Consumer or an Entrepreneur with consumer rights, the User loses the right to withdraw from the contract concluded remotely after the Event, i.e. after the Company has provided the benefit from the forest.
- The above is justified by the content of Art. 38 section 1 point 1) of the Act of May 30, 2014 on consumer rights, according to which the right to withdraw from a contract concluded off-premises or remotely is not available to the Consumer in relation to contracts for the provision of services for which the Consumer is obliged to pay the price, if the entrepreneur has fully performed the service with the express and prior consent of the Consumer , who was informed before the commencement of the service that after the entrepreneur had completed the service, he would lose the right to withdraw from the contract and took note of this. This exclusion also applies to the Entrepreneur with consumer rights.
- Subject to the provisions of section 3-4 above, if the Consumer or Entrepreneur with consumer rights has the right to withdraw from the contract for participation in the Event, he or she may withdraw from the contract within 14 days of its conclusion, without giving any reason.
- If a contract for participation in an Educational Course is concluded before the expiry of the 14-day period for withdrawal by a User who is a Consumer or an Entrepreneur with consumer rights, the User loses the right to withdraw from the distance contract after the entire Educational Course has been completed, i.e. after the Company has provided the benefit from the forest. The above is justified by the content of Art. 38 section 1 point 1) of the Act of May 30, 2014 on consumer rights, according to which the right to withdraw from a contract concluded off-premises or remotely is not available to the Consumer in relation to contracts for the provision of services for which the Consumer is obliged to pay the price, if the entrepreneur has fully performed the service with the express and prior consent of the Consumer , who was informed before the commencement of the service that after the entrepreneur had completed the service, he would lose the right to withdraw from the contract and took note of this. This exclusion also applies to the Entrepreneur with consumer rights.
- Subject to the provisions of section 5-6 above, if the Consumer or Entrepreneur with consumer rights has the right to withdraw from the contract for participation in the Educational Course, he or she may withdraw from the contract within 14 days of its conclusion, without giving any reason.
- The Consumer or Entrepreneur with consumer rights is obliged to inform the Company about his decision to withdraw from the contract by means of an unambiguous statement (for example, by letter sent by letter or e-mail). For this purpose, a Consumer or an Entrepreneur with consumer rights may use the sample withdrawal form constituting Annex No. 1 (applies to Events) and Annex No. 2 (applies to Educational Courses) to these Regulations, but this is not obligatory.
- In order to meet the deadline for withdrawal from the contract, it is sufficient for the Consumer or Entrepreneur with consumer rights to send information regarding the exercise of his right to withdraw from the contract before the deadline for withdrawal from the contract expires.
- In the event of withdrawal from the contract, the Company returns to the Consumer or Entrepreneur with consumer rights all payments received, immediately, and in any case no later than 14 days from the date on which it was informed about the decision to exercise the right to withdraw from the contract.
- The payment will be refunded by the company using the same payment methods that were used by the Consumer or Entrepreneur with consumer rights in the original transaction, unless the Consumer or Entrepreneur with consumer rights expressly agrees to a different solution. Regulation on the decision to exercise the right to withdraw from the contract . In any case, the Consumer or Entrepreneur with consumer rights will not incur any fees in connection with this return.
- In order to eliminate any interpretation doubts, the Company clearly indicates that an entity that is not a Consumer or an Entrepreneur with consumer rights has no right to withdraw from the concluded contract.
§13. NEWSLETTER
- The company from the forest allows Users to subscribe to the newsletter, which service consists in sending the User free commercial information about current Events, activities and promotions related to the activities of the Platform or undertaken by the Company from the forest.
- Using the newsletter service requires:
- indicating the User’s e-mail address in the place designated for this purpose or by expressing such intention in another way, i.e. in particular, by checking the appropriate checkbox when registering on the Platform, purchasing a Subscription or participation in the Event,
- expressing consent to receive information and to the processing of personal data related to the provision of this service,
- User’s connection to the Internet.
- The provision of the newsletter service begins when the User successfully performs the activities indicated in section. 2.

§14. BLOCKING ACCESS TO THE PLATFORM
- The forest company has the right to immediately block the User’s account on the Platform if:
a. The recurring payment for the next billing period of the Auto-renewable Subscription has not been made and cannot be made automatically (e.g. due to lack of funds in the bank account or credit card account or due to the expiry of the credit card validity period),
b. when the User’s behavior is inconsistent with the provisions of these Regulations, legal provisions or principles of social coexistence, i.e. in particular when:
i. there is a gross violation by the User of the rules of using the Platform or there is a suspicion of such violation,
ii. the User violates legal provisions regarding the use of the Platform,
iii. the User’s behavior when logging in puts the security of the Platform at risk or threatens the interests of other Users. - Blocking the account means that the User loses the ability to use the Platform and Subscriptions purchased through it.
- If the reasons for blocking the account no longer exist, the User’s access to his account will be unblocked.
- If the reasons for the blocking do not cease within 1 month from the date of their identification, the company has the right to terminate the contract with the user with immediate effect.
- Blocking the account does not in any way involve the refund of part of the fee paid to the User. If the blocking of the account was objectively unjustified, the Forest Company will extend the period of access to the User’s package by the duration of the blocking of his account.
§15. PROCESSING OF PERSONAL DATA AND COOKIES
- The processing of personal data provided by Users as part of the use of the Platform is carried out in accordance with the provisions of generally applicable law, i.e. in in particular in accordance with Regulation of the European Parliament i Council (EU) 2016/679 from the 27th april 2016 r. w on the protection of natural persons in relationship with processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation ) – the so-called “GDPR”, the Polish Personal Data Protection Act and the Polish Act on the provision of electronic services.

- As part of the functioning of the Platform, information contained in Users’ cookies is automatically collected to ensure proper operation of the Platform, maintain and increase its functionality, as well as enable external advertising campaigns to be conducted. §16. COMPLAINTS PROCEDURE
- Complaints, comments and inquiries regarding the services provided may be submitted to the Forest Company via e-mail to the following address: kontakt@szykolazlasu.pl
- The submitted complaint should include the contact details of the reporting party enabling a response to the report, as well as a detailed description of the problem, i.e. , in particular it should include a justification for the complaint, and also the User’s expectations towards the Company from the forest.
- If the complaint does not contain all the elements necessary for its consideration, the Forest Company will call on the complainant to correct the formal deficiencies in the notification under penalty of the complaint being left unrecognized.
- Complaints will be considered within 14 days from the date of receipt of the complaint containing all the elements indicated in section. 2 and will be forwarded to the complainant in the same form in which he submitted the complaint.
- The response to the complaint will include the resolution of the complaint, the justification for the decision, as well as any intended/taken corrective actions.
- Detailed information on the possibility for the Consumer to use out-of-court methods of dealing with complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and voivodeship inspectorates. trade inspection. §17. FINAL PROVISIONS
- In matters not regulated in these Regulations, Polish generally applicable provisions shall apply.
- For matters arising in connection with the provision of electronic services covered by these Regulations, the applicable law is Polish law. However, if the provisions in force in the consumer’s country are more favorable to him and these provisions cannot be excluded by contract, they will apply in the contract concluded via the Platform.
- The User, without the prior consent of the Forest Company given in writing under pain of nullity, is not entitled to assign the rights and/or transfer the User’s obligations arising from the contract between the User and the Forest Company.
- The Parties will try to resolve any disputes arising from the Users’ use of the Platform. If it is not possible to resolve the dispute amicably, the competent court will be the Polish common court with jurisdiction over the registered office of the Company.
- In the event that any provisions of these Regulations are or become invalid, the remaining part of the Regulations shall remain in force, unless circumstances indicate that without the invalid provisions the action would not have been performed. The parties undertake to immediately enter into negotiations to replace the invalid provisions with a regulation that will be as close as possible to the purpose of the invalid provision.
- The forest company may change or update these Regulations, in particular to:
- take into account changes in services or the way we do business (e.g. new services, features, technologies, prices or benefits),
- take into account changes resulting from legal regulations or regulations related to security,
- prevent abuse or harm.
If the Company introduces changes to the Regulations, registered Users will be notified by e-mail about this change, with the possibility of terminating the contract for the provision of electronic services.
